Several definitions are amended and new definitions are inserted in Section 3 of the Principal Act to address new developments. Section 4 of the Principal Act is amended by inserting a new subsection (2) to compel the Minister to adopt measures and principles relating to conservation and management of fishery and fishery resources. Section 8 of the Principal Act is amended regarding the reporting of unlicensed foreign fishing vessels navigating through Kiribati waters. Section 8 of the Principal Act is amended regarding the period of the validity of a license. The registration of the fishing vessel on the Local Fishing Vessel Registry is inserted into Subsection (3) of the Section 11 of the Principal Act as a condition of granting a license for a local vessel. Section 12 of the Principal Act is amended to enable the Director of Fisheries to impose prohibitive conditions of the license for a foreign fishing vessel. Section 14A and 14B are inserted into the Principal Act to provide for general fishing prohibitions and to require a license for recreational fishing. Part 5A is inserted to the Principal Act for the regulation of the export of seafood by the Minister and the establishment of a competent authority to monitor the fish processing in accordance with the international standards. Section 15A is inserted to the Principal Act regarding the record of fishing vessels by the Directorate of Fisheries and the obligation of the owner or operator of any Kiribati fishing vessel to provide accurate information. Section 23A is inserted to Part 8 of the Principal Act regarding the powers of the authorized officers beyond Kiribati waters and Section 24 is amended accordingly. Section 25 is amended regarding the obligation of authorized officers to produce sufficient evidence to prove his authorization while exercising his/her duties. The word "foreign" in the first line is deleted in Subsection (1) of Section 27 of the Principal Act to broaden the application the section and moreover (h) is inserted under Subsection (3) regarding the offence of resisting lawful arrest. New Subsections (3A) and (3B) are inserted to prohibit the disembarkation of the authorized officers and observers outside the territory or jurisdiction of Kiribati without the consent of the Director of Fisheries. New Subsections (28A) and (28B) are inserted to deem activities contrary to the laws of another state to be offences under the Principal Act. Section 30 of the Principal Act regarding offences and penalties is broadened. New Subsection 39A is inserted regarding the disclosure of confidential information within the authorization. Finally, Section 40A is inserted to the Principal Act regarding the establishment and structure of the Fisheries Administrative Penalty Committee.
