They modify the definitions of “natural habitat” and “protected species” to reflect the consolidation and replacement of Directive 79/407/EEC by Directive 2009/147/EC and update references to legislation under which damage to protected species and natural habitats, and damage on a site of special scientific interest may be authorised and the the list of EU legislation in Schedule 2 of the 2009 Regulations, by reference to which activities will attract strict liability.
