Environmental Authorisations (Scotland) Regulations 2018 (S.S.I. No. 219 of 2018). Country/Territory United Kingdom Territorial subdivision Scotland Document type Regulation Date 2018 Source FAO, FAOLEX Subject Environment gen. Keyword Pollution control Radiation Nuclear energy Legal proceedings/administrative proceedings Enforcement/compliance Governance Geographical area Atlantic Ocean Islands, Europe, Europe and Central Asia, North Atlantic, North Sea, North-East Atlantic, Northern Europe Abstract These Regulations provide a framework for the authorisation of environmental activities ("regulated activities") in Scotland. Regulated activities currently are activities involving either or both— (a) radioactive material; (b) radioactive waste (“radioactive substances activity”). The Regulations transpose provisions of Council Directive 2013/59/Euratom laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation and repealing Directives 89/618/Euratom, 90/641/Euratom, 96/29/Euratom, 97/43/Euratom and 2003/122/Euratom. A registration or authorisation under the Radioactive Substances Act 1993 is deemed to be an authorisation. Activities which are not regulated under the Radioactive Substances Act 1993 but which are radioactive substances activities under these Regulations will generally require an authorisation of the Scottish Environment Protection Agency (SEPA). The Scottish Minister shall provide guidance to SEPA. Provision is made in respect to appeals to the Scottish Ministers and administrative procedures.
