Large undertakings and a small or medium undertakings which fall within the group of the large undertaking (as defined by Schedule 1) shall participate in the Scheme (" relevant undertaking"). A responsible undertaking (as defined) must carry out an Energy Savings Opportunity Scheme (ESOS) assessment, which includes an energy audit. An energy audit must identify energy saving opportunities. Compliance shall be monitored by appointed compliance bodies. The Regulations provide for civil penalties to be imposed by the compliance bodies in respect of certain breaches of the Regulations, and Part 9 provides for appeals against determinations, enforcement notices and penalty notices.
