Abstract This Act states the provisions for domestic fishing within the territorial waters of Niue. There are 4 Parts and 29 provision numbers; Preliminary (Part I); Protection of fish (2); Sunday fishing ban (3) and Safety at sea (4). Part 1 consists of the definitions and explanations of the major phrases used within the Act. Provision 3 lists the prohibited use of illegal fishing means including a prohibition on the New Guinea creeper. The Cabinet may with the concurrence of the village council and Director declare a marine reserve over any part of the reef or Niue waters. There are restrictions on the possession, trade and export of certain species including specified crustaceans, Uga, crayfish, Tapatapa or clam (provision 10). This Act prohibits fishing on Sunday between the hours of four o'clock in the morning and nine o'clock at night at night (provision 13). Ships based on Niue must be licensed under the provisions of the Act as prescribed by the Fisheries officer. Offences and penalties are listed under provision 24. Provision 28 provides for Cabinet to make regulations as may be necessary for the implementation of this Act whereas provision 29 lists the Acts and Ordinances repealed.
