This Decree enters into force on the day of its publication.
Abstract

This Decree, consisting of 11 articles, creates the Extractive Reserve of Baía do Tubarão, located in the Municipalities of Icatú and Humberto de Campos, State of Maranhão. This Reserve aims to: protect the natural resources necessary for the subsistence of traditional extractive populations of the region, with respect and appreciation of their knowledge and culture in order to promote their social and economical development; maintain the coastal environmental resources provided by mangroves and associated water resources; contribute to the recovery of biological resources, to the sustainability of subsistence and small-scale fisheries and extractive activities, and to promote community-based ecotourism. The Baía do Tubarão Extractive Reserve area is 223,917 hectares, and has its limits detailed in topographic charts specified in the text. The passage of pipelines and associated facilities for the oil exploitation logistics, future easements of the pipelines, and infrastructures indispensable for the development of the pipeline, are allowed for oil and natural gas needs. In the maritime area of this Extractive Reserve, including the buffer zone, the freedom of navigation and ship anchoring and the execution of the Maritime Authority actions necessary for the safeguarding of human life at sea, safety waterways and prevention of pollution of the water environment are guaranteed. The imposition of restriction on waterway traffic must be previously approved by the Maritime Authority.
