Decree No. 34 of 1994 of the Ministry of Agriculture regulating the issuance of technical authorizations necessary for the import and export of breeding animals and of materials for reproduction purposes.

Abstract

This Decree applies to the import and export of animal species and breeding material (semen, ovules, embryos, etc.). The Ministry approves a breeding programme prior to importation. There is no need to approve the import, export and transit for exhibition or competition purposes if breeding animals and material are transported back into the country of origin, and if this condition is credibly certified. Applications for approval shall be submitted to the Ministry by the owner of the animal or by his/her representative. Other requisites regarding the contents of the application are specified in Article 3. Technical approval of the Ministry does not concern other legal duties of the applicant (import and veterinary licence). The former only entitles the introduction, transport and storage of breeding animals and material. Within 48 hours of arrival in the appointed quarantine, the applicant, under Article 3(1), should report in writing to the National Institute for Agricultural Quality Control, which is responsible for monitoring this Decree, in accordance with Article 18(2)(d) of the principal Law. Procedures following quarantine actions are regulated in Articles 8-9 (customs formalities, naturalization, etc.). Article 10 deals with the export of protected indigenous and endangered animals of high genetic value as well as material originating from them, of state-owned male animals with artificial insemination licence, and of animals of publicly subsidized breeding stocks and their breeding materials. Animals and materials for export require certificate of origin authenticated by th Institute. Breeding materials require a quality certificate as well. Approvals are valid for 90 days and are extendable for a further 15 days.
