Decree No. 1231 of 2010 relative to electronic reporting for vessels flying the flag of Member States of the European Union (EU) in the Economic Zone, territorial waters and the fisheries zone around Jan Mayen.

Abstract

This Decree sets regulations on reporting of catch and fishing activity by foreign fishing vessels operating in the Economic Zone, territorial waters and the fisheries zone around Jan Mayen. By access to Norwegian ports with catch on board, the reporting requirement applies irrespectively of which catch area. Digital notification shall include information which includes start of fishing reports, vessel particulars (authentication code, personnel, measure of vessel, specific NAFO fishing area locations), planned target species (FAO fish species code) and quantity, ICES area where fishing should start, requirements for vessel registered as EU Member State, or Icelandic or Faroese registration. The Decree is regulated by the Department of Fisheries and Coastal Protection. ART. 6 - Catch reports shall also be submitted for inspection at sea, and on the same day prior to port reporting, notification of termination of fishing activity or notification or requests for ínspection are sent. ART. 7 - It is not permitted to land catches to other vessels than the ones in possession of fishing license in accordance with Order No. 2 of 13 May 1977 on foreigners fisheries in the Economic Zone and landings in Norwegian ports by vessels from EU Member States, Russia, the Faroe Islands, Greenland, Iceland, Norway, and from NEAFC partner countries. ART. 8 - Port reporting is submitted regardless of whether landed catch and is notified no later than 2 hours before entering Norwegian ports. Vessels that received catches from another vessel shall, regardless of where the landing took place, submit a port report at least 24 hours prior to landing in a Norwegian port. ART. 9 – Departure from ports must be notified latest 2 hours after departure. ART. 10 – At closure of fishing, vessels must notify prior to sailing out of Norway's economic zone or fisheries zone around Jan Mayen, however not when the vessel enters territorial waters. Notification of inspection applies at conclusion of fishing in the zone north of 62 degrees N and at prescribed control points. Vessels licensed to fish for herring south of 62 degrees N and mackerel in the Economic Zone shall discontinue fishing activity and report for inspection, while vessels landing their catch in a Norwegian port after fishing in the Norwegian economic zone shall not notify for control.
