Abstract

Art. 1 of the Decree Law No. 39/2023 on urgent provisions for the contrast of the water scarcity and for upgrade and adaptation of water infrastructure establishes a Control room for the water crisis, hereinafter referred to as "Control room". The Control Room performs direction and coordination functions and monitors for containment and contrast of the water crisis. The Control Room has specific swap powers conferred under Art. 2 in situation of dissensus and urgency. Art. 3 sets the basis for the nomination of the Extraordinary National Commissioner, and Art. 5 to ensure water availability for irrigation, human consumption, industrial and power generation confers powers to the Commissioner to negotiate with the Regions measures aimed at ensuring an efficient use of reservoirs for the fight against the water crisis. Art. 4 contains urgent provisions for the realization, strengthening and the adaptation of water infrastructures that simplify the previous regime. The new regime applies to: short-term developments to contain the urgent water crisis; modifications, extensions or technical adaptations aimed at improving performance and environmental performance of water infrastructure; upgrade and adaptation of water infrastructure, as well as the increase of safety and capacity recovery of water reservoir; among others. Art. 6 introduces measures that allow the use of rainwater collection tanks for irrigation purposes without need of permit, within a certain volume of water. Art 7 authorizes the use of depurated waste water for irrigation purposes. Art. 10 makes changes to the discipline of desalination plants; A. 12 of the Law No. 60/2022 is amended by requiring a preventive environmental impact assessment. Art. 13 establishes permanent District Observatories to contrast water scarcity. Art. 14 reinforce the discipline of penalties for water abstraction offences and negligence in dam management.
