Abstract

This Regulation amends and supplements Regulation (EEC) No. 2081/92 which sets out a framework for a Community scheme to register and protect products to be qualified as protected designation of origin (PDO) or as protected geographical indication (PGI). Article 1 (1) shall be replaced by the text laid down in article 1 (1) hereto, on the basis of which that Regulation lays down rules on the protection of designations of origin and geographical indications of agricultural products intended for human consumption referred to in Annex I to the Treaty and of the foodstuffs referred to in Annex I to this Regulation and the agricultural products referred to in Annex II to this Regulation. The foodstuffs listed out in Annex I comprise beer, beverages made from plant extracts, pasta, mustard paste, bread, pastry, cakes, confectionery and other baker's wares. Annex II, on the other side, includes agricultural products such as cork, flowers and ornamental plants, wool. The amendments and addenda hereby laid down refer mainly to the registration procedure. Namely, the subparagraph laid down in article 1 (4) of this Regulation shall be added after article 6 (1) of Regulation (EEC) No. 2082/91. In accordance with this new provision, the Commission shall make public any application for registration, stating the date in which the application was made. Any notice of cancellation shall be published in the Official Journal of the European Union. New article 11c defines the cases in which the Commission may cancel the registration of a name. After article 12, articles 12a, 12b, 12c and 12d shall be inserted. These new provisions regard the submission of the application for registration by a group, a natural person or a legal person in a third country wishing to have a name registered under Regulation (EEC) No. 2081/92.
