This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union and apply from 1 July 2023.
Abstract

This Regulation stresses on the need to update the fees payable to the Community Plant Variety Office to cover the costs of activities carried out by the Office. To this end, this Regulation makes amendments to the Regulation (EC) No 1238/95 by increasing the annual fee paid by a holder of a Community plant variety right (Article 9); by raising appeal fee (Article 11); and by fixing administrative fees: (i) concerning the declaration of Community plant variety right null and void, (ii) concerning a written objection to granting a Community plant variety right, and (iii) referred to in Article 8(5) and Article 82(2) of the Proceedings Regulation (Article 12). Annex I setting out the level of fees for arranging and carrying out the technical examination of a variety which is the subject of an application for a Community plant variety right is replaced by the text in the Annex to this Regulation.
