Circular No. 14153/161087 of 2014: Application of Article 95 of Regulation (EU) No. 528/2012 of the European Parliament and of the Council of May 22, 2012 regarding the placing on the market and the use of biocides, as amended by Regulation No. 334/2014, in the biocidal preparations under the jurisdiction of the Ministry of Agricultural Development and Food in our country.

Abstract

This Ministerial Circular concerns the application of article 95 of the Regulation (EU) No. 528/2012 of the European Parliament and of the Council of May 22, 2012 regarding the placing on the market and the use of biocides, in its last amended version, and provides for the necessary clarifications to the holders of biocides products approved under Ministerial responsibility. According to the Circular, no biocidal products have to be placed on the market, if the manufacturer or importer of the active substance(s) contained in the product is not included in the list drawn up by the European Chemicals Agency (ECHA), and does not participate in the evaluation program of the active substance(s). The Circular also provides for: a classification of the approved biocides, according to the provisions of European and National Legislation; the prescribed fees for the producers of biocides.
