Abstract

This Act lays down rules concerning the decision on prohibition of trade affecting business operators who are subjected to limitations for a certain period in the right to conduct or participate in business activities. Any business operator who has seriously neglected their obligations in business activities and thereby committed non-trivial criminal offenses shall be subject to prohibition of trade if such prohibition is necessary from a public perspective. A prohibition of trade shall be imposed for a specific period of at least three and at most ten years. The Act contains specific rules on the conditions for prohibition of trade; when prohibition of trade is deemed necessary from a public perspective; the implications of the prohibition of trade; motions for prohibition of trade; judicial handling of cases regarding prohibition of trade; revocation of the prohibition of trade; exceptions from the prohibition of trade; register of prohibitions of trade; etc.
