The company brought a claim before the CFI on 21 December 2007, in which it contested that methomyl, a pesticide used in many plant protection products, was not included in Annex I to Council Directive 91/414/EEC. In the order, the CFI refused the suspension of Council Directive 91/414/EEC, declaring that the interim measures are not justified as the contested decision would not cause serious and irreparable damage.
