Abstract

The Constitutional Court is asked to review the constitutionality of the WHO Framework Convention on Tobacco Control adopted on 21th May 2003.

The WHO Framework Convention on Tobacco Control has the objective to protect both present and future generations against  social, environmental and economic effects from the consequences of tobacco consumption and exposure to tobacco smoke.
The Convention includes provisions on demand reductions measures, protection of the environment, responsability, and scientifical and technical cooperation. The Convention's objectives are in line with social and cultural rights recognised by the Constitution of 2 June 1991.  Consequently the WHO Framework Convention on Tobacco Control complies with the Constitution.
