Résumé

Objectives: To ensure the long-term conservation and sustainable use of highly migratory fish stocks in the western and central Pacific Ocean, in accordance with the 1982 Convention on the Law of the Sea and the 1995 Agreement for the Implementation of the Convention's Provisions relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks (art. 2). Summary of provisions: Part II of the Convention deals with the conservation and management of highly migratory fish stocks, Part III establishes the Commission and defines its functions which are, inter alia, to determine the total allowable catches and/or total level of fishing effort within the Convention Area for highly migratory fish stocks as well as adopt such other conservation and management measures and recommendations as may be necessary to ensure the long-term sustainability of such stocks and of non-target species and species dependent on or associated with the target stock (art. 10). The Commission is also, inter alia, to promote co-operation and co-ordination between its members, adopt generally recommended minimum standards for the responsible conduct of fishing operations, and establish appropriate and co-operative mechanisms for effective monitoring, control, surveillance and enforcement of conservation and management measures. Further provisions deal with, inter alia, transparency and co-operation with other organisations, including the Food and Agriculture Organisation (FAO), duties of the flag State, compliance and enforcement, development of a regional observer programme, and regulation of transhipment. Institutional mechanisms: The International Commission for the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean is established (art. 9), with two subsidiary bodies, the Scientific Committee and the Technical and Compliance Committee, to provide advice and recommendations to the Commission on matters within their respective areas of competence (art. 11).
