The Law enters into force on the date of its official publication.
Résumé

This Law lays down legal grounds for ensuring efficient protection and rational management of wild fauna. It shall not be applicable to domestic animals and captive breeding. Wildlife shall be public property. Any action or inaction violating the right of public ownership of wildlife shall be prohibited. The Act consists of seven Sections divided into 48 articles: (1) general provisions; (2) protection of wildlife; (3) management of wildlife; (4) registration of wild fauna species; (5) control and inspection; (6) liability; and (7) conclusive and transitional provisions. The basic requirements for conservation and management of wild fauna shall be: (a) conservation of biological diversity; (b) protection of habitats; (c) regulation of the population of wild animal species; and (d) full compensation of damage caused to wild fauna. Protection of wild fauna shall be carried out by means of: (a) establishment of rules and regulations for conservation, protection and reproduction of wild animals; (b) protective arrangements; (c) suppression of illegal use of wild fauna; (d) protection of migration routes; (e) liability and compensation for damage caused to wild fauna and habitats; (f) creation of protected areas; (g) captive breeding of rare and endangered species; (h) research; (i) monitoring; and (j) education. Collections of wildlife products shall be subject to compulsory state registration. Unauthorized transfer, acclimatization and breeding of wild animals shall be prohibited. The following activities carried out in accordance with the legislation shall be authorized: (a) sport and artisanal hunting; (b) industrial, sport and artisanal fisheries; (c) use of wild fauna for research, educational and aesthetic purposes; and (d) use of wildlife products.Specially protected area for avifauna shall be intended a natural area designed to preserve, maintain and, as appropriate, restore a favorable conservation status for bird species and specific habitats for the protection of migratory wild bird species. Hunting park shall be intended enclosed hunting grounds with an area of 10 to 200 hectares of forest and/or agricultural land for keeping and hunting captive hunting fauna (game). Protection of wild fauna shall be ensured also by selection hunting. Selection hunting is organized and conducted by the manager of the hunting fund, and in state protected natural areas - by the manager's employees. Selection hunting is conducted individually, in ambush, using rifled weapons. The procedure for organization and performance of selection hunting shall be established by a regulation approved by the Government and developed by the central state body for natural resources management and environmental protection. In order to protect endangered species listed in the Red Book, the following measures shall be established: (a) creation of objects and complexes included in the fund of natural territories protected by the state, mainly on the land where the animals listed in the Red Book are distributed and on the migration routes of such species; (b) prohibition to remove animals from their natural environment, except for the cases provided for in paragraph (3) of Article 27; and (c) prohibition to disturb animals in their natural habitat, especially during reproduction, wintering and migration. Termination of the right to use animal resources shall be implemented by cancelling the permit for use wild fauna, performed by the issuing authority. Hunting management planning of state forest fund shall be performed by the central state authority on forest management and shall be carried out once in ten years simultaneously with the forest inventory conducted by forest management service.
