Résumé

This Regulation is divided into 8 Parts and enacts the Water Act. Part 1 deals with activities and states that the placing, constructing, installing, maintaining, replacing and removing of a pipeline crossing or telecommunication line crossing or a watercourse crossing are designated activities that do not require an approval. However they must be carried out in compliance with the relevant codes of practices, (sec 3). Written notice must be provided to the Director at least 7 days before the activity is commenced. Work must then commence within one year of the date the notice was provided, failing which, further notice is required, (sec 4). There are exemptions from the requirement of approval contained in schedule 1 and 2. Part 2 deals with diversions and transfers. Section 6 states that the temporary diversion of water for hydrostatic testing of pipelines must be carried out in compliance with the relevant codes of practice. Notice is required as already described above. This part also outlines licences in detail. Part 3 deals with notices in depth. Part 4 outlines access to information and specifies the type of documents and information that must be disclosed to the public in a provided form and manner. Part 5 applies to appeals conducted by the Land Compensation Board pursuant to section 158 of the Act. Part 6 sets out the provisions relating to dam and canal safety. It outlines procedures relating to emergency preparedness plans, flood action and plan and operation, as well as maintenance and surveillance manuals. It further deals with site and safety assessments and evaluations, as well as safety directives. Part 7 highlights the provisions concerning water wells and contains two tables with regards to drilling restrictions, and drilling specifications. Part 8 deals with transitional provisions, consequential amendment and their repeals, expiry and coming into force.
