Résumé Water Code is aimed at the improvement of the rational use and conservation of water resources. The present Code together with the organizational, legal, economic and educational arrangements shall contribute to the formation of water and ecological legislative order and ensuring economic safety of Turkmenistan. The purpose of water legislation is to regulate water relations for the purpose of ensuring scientifically substantiated water management, prevention of water pollution, siltation and exhaustion, prevention and liquidation negative impact of water (art. 1). State water stock includes: 1) rivers, water reservoirs, lakes, drainage systems and other surface water bodies; 2) groundwater; 3) the Caspian sea within the national state boundaries (art. 3). The state water stock pertains to the exclusive state property. Any action violating directly or indirectly the right of the state property shall be prohibited (art. 4). The purpose of the state control over the use and protection of water is to enforce the observance of water legislation, registration of water uses and observance of water management regulations (art. 9). Water uses are classified as follows: 1) general (without the use of technical means and devices causing impact on the state of water) and special (supply of potable water and water supply for consumer needs, water supply for agriculture and fisheries, industry, energy sector and effluent water discharge); 2) joint (managed by several water users) and separate (managed by a single legal or natural person); 3) primary (carrying out water abstraction and transportation of water through pipe-lines) and secondary (receiving water from them) (art. 17). Water use except for charged water uses envisaged by the national legislation is free of charge (art. 29). Unauthorized regulation of waterworks for the purpose of increase or reduction of water flow shall be prohibited (art. 55). The following actions shall be prohibited in fishing water bodies: 1) blockage and obstruction of rivers and channels; 2) bathing of animals and grazing of poultry; 3) other activities having negative impact upon the state of fish stocks and reproduction thereof (art. 62). The Act consists of 17 Sections composed of 73 articles.
