Résumé

This Chapter of the Code of Virginia concerns tree and crop pests in Virginia. It provides that the Commissioner of Agriculture and Consumer Services shall protect the agricultural, horticultural, and other interests of the Commonwealth from plant pests. The Commissioner shall also direct abundance surveys for plant pests and may carry out operations or measures to locate, suppress, control, eradicate, prevent, or retard the spread of pests. In addition, the Board of Agriculture and Consumer Services may quarantine the Commonwealth or any portion thereof when it determines that such action is necessary to prevent or retard the spread of a pest into, within, or from the Commonwealth. The Board may also prohibit the importation of any regulated article from any locality of other states, territories, or countries, into the Commonwealth. The Chapter also establishes the Cooperative Suppression Program Fund which will be used for the purpose set forth in the Department's Gypsy Moth Cooperative Suppression Program Guidelines. Further, the Chapter provides for authority for compensation to growers in infested areas; penalties for violating the provisions of the Chapter; division of costs of administration and reimbursements that need to be made to Commonwealth for pest measures; and the permits that are required to sell and transport plant pests in Virginia.
