Section 7 states that “In the administration of this Act, the Minister shall have regard to the rights and obligations conferred on Australia by the Torres Strait Treaty and in particular to the traditional way of life and livelihood of traditional inhabitants, including their rights in relation to traditional fishing.” Part 3 provides for the framework for the Commonwealth-State management of fisheries. The Act is completed by one schedule that contains the text of the Torres Strait Treaty – Treaty between Australia and the Independent State of Papua New Guinea concerning sovereignty and maritime boundaries in the area between the two countries, including the area known as Torres Strait, and related matters.
