The monitoring of the condition of greenery and greenery in the territories of municipal greenery and greenery shall be carried out by municipalities in accordance with the monitoring plan of the condition of greenery and greenery prepared by the Minister of the Environment.

Résumé

The purpose of this Law is to establish the bases for the legal regulation of the protection, maintenance and management of green areas and greenery, the establishment of green areas and the cultivation of green areas, as well as public relations ensuring the uniqueness and quality of the landscape and urban environment. This Law shall not apply to plants growing on forest land, agricultural plants growing on agricultural land and abandoned agricultural land areas overgrown with woody plants, except for green areas and protection greenery growing there. Separate greenery shall be intended a park, city or town garden, square or other greenery located on a plot of land, which according to the method of its use is classified as separate green area. Historic greenery shall be intended a greenery of enduring historical, stylistic, artistic value or important for urban development, related to social, cultural or state events or personalities. Park of national significance shall be intended a park with special historical, architectural, cultural, scientific, aesthetic, ecological, dendrological and/or landscape value recognized by experts and/or scientists and included in the list of parks of national significance approved by the Government of the Republic of Lithuania. Public greenery plantations shall be intended greenery in the territories of municipalities intended to meet the needs of the public, or separate and dependent greenery and greenery on public land, for the visit, protection and maintenance of which is based on contract concluded between the state land manager and the municipal executive body, as well as greenery on private land, for the visit, protection and maintenance of which a contract is concluded between the owners of private greenery and the municipal executive body; it also includes botanical gardens of Lithuanian universities and greenery growing in them which are not included in public greenery. Protection, maintenance and management of greenery, establishment and planting of greenery shall be based on the following principles: (a) sustainable development; (b) priority of public interest; (c) professionalism and responsibility; (d) continuity; and (e) ensuring well-being of green areas. The felling of protected plantations, otherwise removal from the place of growth or intensive pruning may be carried out only with a permit issued by the municipal executive body for felling or in accordance with a valid decision of the municipal executive body. The monitoring of the condition of greenery in the territories of municipal greenery shall be carried out by municipalities in accordance with the monitoring plan of the condition of greenery prepared by the Minister of the Environment.
