Résumé These Regulations, made by the Minister under section 228 of the Merchant Shipping Act, concern preliminary inquires and formal investigations in the event of shipping casualties. The Regulations specify that a preliminary inquiry of a shipping casualty is conducted in accordance with the provisions of the main Act and in collaboration with the substantially interested State. The Regulations define the conditions of shipping casualties, including: casualty occurred in territorial sea or within internal waters; shipping casualty threatening serious harm to the environment of a State, or to its artificial islands, installations, or structures. The Regulations provide for: damage assessment; designation of surveyor; keeping of information and records; marine safety investigation conducted by any substantially interested State; offences.
