Résumé

There is hereby made a scheme that shall apply to all varieties of maize that conform with the characteristics of cultivated varieties of the species zea mays. The period for which plant breeder's rights are exercisable in respect of those plant varieties is 15 years. Regulation 5 prescribes varieties of maize, sweetcorn and popcorn for purposes of section 21 of the Seeds and Plant Varieties Act. For purposes of section 23 (4) of the Act (compulsory licensing), a compulsory licence granted by an authorized officer in respect of a prescribed plant variety of maize shall not have effect for a period of two years after the date of the grant of rights in that variety. A person who infringes the plant breeder's right in the registered name of a variety of root and tuber crops covered by the scheme here introduced, commits and offence. (7 regulations)
