The period for which plant breeder's rights are exercisable in respect of those plant varieties is 15 years. Regulation 5 prescribes varieties of maize, sweetcorn and popcorn for purposes of section 21 of the Seeds and Plant Varieties Act. For purposes of section 23 (4) of the Act (compulsory licensing), a compulsory licence granted by an authorized officer in respect of a prescribed plant variety of maize shall not have effect for a period of two years after the date of the grant of rights in that variety. A person who infringes the plant breeder's right in the registered name of a variety of root and tuber crops covered by the scheme here introduced, commits and offence.
