This Law enters into force 3 months after its publication in the Official Gazette.
Résumé

This Law consists of 4 Chapters divided into 22 articles. Chapter I gives terms and definitions. The Implementing Regulation provided for in Article 2 of Royal Decree No. 8 of 2003 shall be issued to carry out the following objectives: (a) definition of licences necessary to practice any activity relating to animal resources and pastures; (b) regulation of the marketing of animal wealth, animal products, animal feed as well as laying down the necessary requirements and conditions for their production; (c) selection of the animals to breed, which shall be suitable and adaptable to the local environment; (d) definition of the methods and systems adopted for animal reproduction and multiplication; (e) definition of the requirements and conditions for scientific research and studies on animals and for the issuance of licences; (f) definition of the conditions and instructions for animal production; (g) definition of the measures and arrangements for animal health and animal resources prevention and protection; (h) definition of the conditions for the trade, transfer and transportation of animals between the provinces; (i) definition of an animal database which shall be presented by animal owners; (j) definition of the service taxes and fees for the Ministry of Agricultural and Fish Resources; and, (k) definition of the competences and duties of the Animal Resources Management and Pasture Committees (art. 2). The Ministry of Agriculture and Fish Resources shall define the places and sites for the sale of animals (art. 3). Possible complaints and appeals shall be presented to the Minister within 30 days from the date of the communication (art. 4). The regulation of irregular positions shall be carried out within 6 months from the date of the entry into force of this Law (art. 5). Chapter II deals with matters related to pastures as follows: (a) pastures shall be State property of public utility, and the Ministry shall define and regulate their exploitation with the competent authorities; (b) cultivation of pastures, cutting or burning trees and plants, construction of installations, exploitation of pasture products, introduction of new species of plants, grazing and breeding animals, and transfer of the pasture soil shall be prohibited; and, (c) grazing in natural pastures or in protected areas defined by the Competent Unit in the zone shall be prohibited (arts. 6 to 10). Chapter III deals with Animal Resources Management as follows: (a) creation of a register for animal owners, shepherds, breeding sites and pastures, and the number of animals and birds; (b) the storage of animal feed and feedstuff shall be carried out according to the provisions provided for in the Implementing Regulation; (c) the creation of animal production farms need the approval of the Competent Unit; and, (d) prohibition to process and produce animal products or animal feed for trade without the approval of the Competent Unit (arts. 11 to 19). Chapter IV deals with penal provisions (arts. 20 to 22).
