Résumé

This Resolution is composed of 2 articles and 5 Annexes. The Importation and Exportation Licensing System of Ozone Layer Depleting Substances (ODSs) deals with the following matters: (a) licences for the use, importation and exportation of ODSs; (b) purposes of licences are to control the quantity of ODSs, to create a database of the imported and exported quantity of ODSs and to facilitate the control of illegal importation; (c) training of specialists and customs for the control of ODSs in all crossing points, ports and airports; (d) written authorization for the importation of ODSs by the Ministry of Environmental Affairs after the applicant has provided all the necessary documentation; (e) registration of importers or exporters of ODSs in the Register of the Ministry of Environmental Affairs; (f) written approval of the Ministry of Environmental Affairs for Customs to release ODSs; (g) distribution and share by the Ministry of Environmental Affairs of ODSs in order to guarantee the freezing of the CFC materials; (h) the complete interruption of the importation of CFCs within 2010; (i) calculation by the Ministry of Environmental Affairs of the average of ODSs imported by each importer as well as fixing the maximum quantity; (k) requirements and conditions for application and control mechanisms; (l) Control System of the Customs; (m) requirements and conditions for the storage of the confiscated substances; and, (n) collection of database and reporting. Annex 1 contains the form of the Ministry of Environmental Affairs concerning the importer’s share of CFCs. Annex 2 contains the list of the materials subject to control. Annex 3 provides the form for the registration of the importation and exportation of ODSs. Annex 4 contains the application form for the importation and exportation of substances subject to control. Annex 5 lists the maximum noise limits.
