Résumé: The Resolution regulates extraction of state-owned sunk scrap and non-ferrous metal from territorial sea and internal waters of Georgia. The Resolution provides for the requirements for issuing a license for undertaking such an activity. It consists of 11 articles: Purpose (1); Administrative agency issuing the license (2); Rules for issuing the license (3); Rules and terms for issuing/revoking the license (4); Grounds to denial to issue the license (5); Appellation of the denial to issue the license (6); Rights and duties of the issuer of the license (7); License form (8); Addition requirements (9); Extracting sunk property by a sea port authority (10); and Transitional provisions (11). According to the regulation, the seeker of the license must provide an authorization from the relevant port. Ports however have the right to deny such an authorization for reasons such as risk to human life, maritime safety and protection of environment. Further, ports, to avoid the noted risks, may extract the property on their own.
