Résumé

The Resolution provides legal rules in compliance with Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade and the Stockholm Convention on Persistent Organic Pollutants. The Regulation consists of 21 articles: Purpose (1); Scope of application (2); Definition of terms (3); Designated national agencies (4); Notice on chemicals and pesticides prohibited or strictly restricted by the Rotterdam Convention (5); Obligations for importing chemicals and pesticides subject to PIC Procedure (6); Documentation required for obtaining permit on importing certain hazardous chemicals and pesticides (7); Agency issuing the permit and procedure (8); Validity period and terms of import permit (9); Agency registry of import permits (10); Exchange of information between designated national agencies (11); Rules for denial of import permit and appellation (12); Duties and rights regarding import permits (13); Loss or damage to an import permit (14); Compliance control of import permit (15); Notice on export given to Parties or other countries (16); Notices received from Parties and other countries (17); Obligations associated with exporting chemicals and pesticides (18); Information that are provided together with chemicals and pesticides (19); export-import control of chemicals and pesticides (20); and Liability (21). The Regulation also includes as its annexes the list of prohibited and restricted chemicals under the Rotterdam and Stockholm Conventions as well as various forms for permits and information exchange as provided under this Regulation and the Conventions. In general, the Resolution aims to define responsibilities of individual state entities for better protection of human health and the environment; and to encourage safe use of certain hazardous substances and pesticides.
