Résumé

This Resolution, consisting of 86 articles divided into four Chapters and four Annexes, establishes that any activity is subject to environmental licensing at the state level according to the criteria of potential polluter, size and location, whose framework must be established by the competent environmental agency, meeting, at least, the following criteria. The polluting/degrading potential of the activities and undertaking will be considered as Small, Medium, Large, through the environmental variables of air, water, and soil, fauna and flora, under the terms of specific legislation; The size is considered Minimum, Small, Medium, Large or Exceptional according to the pre-established parameters and limits for each activity or enterprise; The classification of enterprises and activities in classes will take place according to the conjugation matrix of the polluting potential and its size. The competent environmental agency will be responsible for defining the enforcing criteria, detailing the list of projects, activities and works subject to environmental licensing and/or authorization, taking into account the peculiarities, environmental risks, size and other characteristics of the project, activity or constructions.
