The Regulations also concern the identification of agricultural land suitable for expropriation and lays down the method of calculating whether an agricultural land is highly suitable, suitable, moderate suitable or not suitable for expropriation (scoring criteria for agricultural land). The Minister, after having - (a) identified agricultural land for expropriation; and (b) conducted a suitability assessment of the agricultural land as contemplated these Regulations, must for the purposes of section 14(1) of the Act score the agricultural land in accordance with the scoring criteria set out in the Annexure. The Minister, after consultation with the Commission and having scored the identified agricultural land may decide to expropriate the identified agricultural land.
