Résumé

These Regulations are made by the Regulatory Board of the Rwanda Utilities Regulatory Authority by virtue of the powers conferred on it by the Organic Law n° 04/2005 of 08/04/2005, the Law N°07/2009 of 27/04/2009 and Law n° 09/2013 of 01/03/2013 establishing Rwanda Utilities Regulatory Authority (RURA). These Regulations are meant to provide a regulatory framework for the design, installation and operations that recycle, compost or covert solid wastes in Rwanda. They apply to persons engaged in all type of activities which involve the recycling of solid wastes with the exclusion of activities involving hazardous waste, E-waste, wastewater treatment and combustion facilities. The Regulations specifically mention plastic, metal, glass, paper, cardboard, organic wastes and other solid wastes as recyclable fractions. The Regulations are made under the objectives to protect the public health and environment and to encourage the diversion and recovery of recyclable materials. The Regulations provide extensively for the requirements to operate a waste recycling unit, the suitability of the waste recycling site, the location of the recycling facility and the modalities for the installation of solid waste recycling facilities, including the specifications on the requirements for recycling plastic, metal, biodegradable wastes, and paper and cardboard. The Regulations provide against the indiscriminate creation of dump sites; these require approval from the competent authority. Generally, any activity relating to the operation of solid wastes recycling facility requires a license issued by the Regulator on the fulfilment of prescribed conditions; operating such facilities exposes the operator to a fine and suspension of their activities.
