Résumé This Regulation sets out rules regarding health claims concerning food and food supplements to be delivered to the final consumer in order to provide a high level of consumer protection. This Regulation lays down provisions on health claims used in the labelling, presentation and advertising of food and food supplements offered to the final consumer. Article 5 underlines that the use of health claims shall not: (I) be false, ambiguous or misleading; (II) give rise to doubt about the safety and/or the nutritional adequacy of other foods; (III) encourage or support excess consumption of a certain product; and (IV) refer to changes in bodily functions which could give rise to or exploit fear in the consumer, either textually or through pictorial, graphic or symbolic representations. This Regulation determines the legal and criminal liability of the food businesses. The Turkish Medicines and Medical Devices Agency may publish guides or notifications for the implementation of this Regulation if deemed necessary.
