Résumé

This Ministerial Regulation, implementing the provisions of articles 215 (2) and 216 of Government Regulation no. 101 of 2014 regarding the management of hazardous and toxic waste and repealing the Regulation of the Ministry of Environment no. 33 of 2009 regarding procedures for recovery of waste contaminated land from hazardous and toxic materials, consists of 43 articles and five annexes and concerns guidelines for the remediation of soils contaminated by hazardous waste. 
This Ministerial Regulation defines the following relevant terms: hazardous and toxic materials; waste; hazardous and toxic waste; environmental function recovery; contaminated land; recovery success; post-recovery; approval of environmental function recovery plan; waste collector; waste carrier; waste utilisation; waste processor; hazardous waste landfill; dumping; environmental supervisory office. Concerning the restoration of land contaminated by waste, the Regulation provides the measures to: identify the contamination, determine the scale of the pollution, prepare a plan to restore environmental functions, undertake cleanup activities, and conduct post-remediation monitoring. The restoration process is organised in five stages: 1) planning; 2) implementation; 3) surveillance; 4) evaluation; 5) post-recovery monitoring.
