Résumé This Regulation defines social evaluation on the following: a) protected species of plants; b) protected species of animals; c) trees growing apart from forests. The social evaluation of protected plants, animals and trees reflect their biological, ecological and cultural value, specified by taking into account their rarity and the degree of endangerment. The social evaluation of protected plants, animals and trees is mainly applied with a) weighing the seriousness of the action consisting of their damage, killing, destruction or other unlicensed disposal thereof; b) decision making on the extent of subsidiary planting; c) working out experts’ references and opinions. Damage to a protected species of plants and protected species of animals according to par. 3, are also considered to be disturbing intervention in their natural development as is their unlicensed collection, rearing, relocation, interfering with their reproduction, destruction of a nest. The social value of damaged subjects of protected species of plants and protected species of animals is defined in the extent from 10 % to 100 % of the social value established in Annex No. 1 of this Regulation.
