Résumé

The State Consumer Protection Board of Estonia is a government office functioning in the regulation area of the Ministry of Economic Affairs which is concerned with the national regulation of consumer protection. The board provides national supervision and applies, if necessary, national forcing methods on the bases of and to such extent as provided by law. The objective of the board shall be protection of the lawful rights of consumers and promotion of their interests. The board shall execute protection of the lawful rights and interests of consumers with respect to all entrepreneurs, despite the form of ownership or departmental subordination of the enterprise, who in their relationship with consumers sell, produce/provide, or intermediate products or services. The functions of the board at regulating consumer protection shall be: (a) to ensure the legal rights of consumers in their relationship with the seller of a product or service; (b) to ensure the fulfilment of the seller's legal commitments in their relationship with consumers; (c) to provide supervision, if necessary, over the fulfilment of the mandatory obligatory to a product or service; (d) to protect in contracts between sellers and consumers the rights of consumers as more fragile parties to an economically contractual relationship; (e) to represent consumers pursuant to the procedure provided by law in state and local government agencies; in enterprises producing/providing, selling, or intermediating products or services; in court; in court of arbitration; in organisations of producers, sellers, or consumers; and in international consumer protection movements; (f) to apply liability for violation of the requirements of the Consumer Protection Act and liability for administrative offences pursuant to law; and (g) to arrange for indemnity to consumers for damage caused with the unlawful acts of a seller or employee.
