Résumé

This Regional Act, consisting of four Titles, regulates the research, the cultivation as well as the use of mineral and thermal waters, with a view to protecting and improving hydromineral resources. Mineral and thermal waters originating in underground stratums or layers, and received by the territory of Umbria, belong to the regional property. Title II of the Act concerns the research and the cultivation of mineral and thermal waters. A permit issued by the Region is needed to research mineral and thermal waters. The holder of the permit is entitled, inter alia, to intake water and carry out tests in order to assess the chemical and physical features as well as healing and medicinal characteristics. The application shall be submitted to the President of the Regional Council and accompanied by the documents specified by article 3. Articles 4 and 5 regulate the issuance and the duration of the permit respectively. Article 8 concerns the regional concession for the cultivation of layers of mineral and thermal waters. Article 21 regards the termination of the permit and the concession. Article 36 regulates the transferability of the permit and the concession upon authorization granted by the Regional Council. Title III concerns the use of mineral and thermal waters, giving particular regard to the authorization. Article 46 refers to the labels of mineral water containers, which shall specify, among others, the name "natural mineral water" and the results of chemical and physical tests. Article 49 regards the authorization for thermal establishments. Title IV lays down provisions in matter of inspection and controls and sets out penalties. Furthermore, holders of concessions must keep and update the registers referred to in article 59.
