The Regional Act has entered into force on 17 December 1999.
Résumé

The Regional Act sets up the Regional Agency for Environmental Protection of the Molise Region (ARPAM), in implementation of Legislative Decree No. 502 of 30 December 1992 as well as Decree-Law No. 496 of 4 December 1993, which has established the National Agency for Environmental Protection (ANPA). This Act, consisting of four Titles and two Annexes, aims at coordinating ARPAM's activities with the assignments pertaining to local entities and the sanitary service of Molise, with a view to restricting and removing risks and hazards to human health and to the environment (art. 1). The Region shall in particular: (a) define general objectives relevant to sanitary and environmental matters; (b) encourage the participation of local entities in the elaboration of environmental planning; (c) adopt directives and coordinating measures; (d) promote cooperation with operators of the environmental sector. Title II gives full details relative to the arrangement and functions of the ARPAM, which shall be effectively established by Decree of the President of the Regional Council within 120 days from the date of entry into force of this Act. The ARPAM shall exercise technical and inspective functions in matter of pollution control and shall perform analysis intended for environmental and sanitary assessment. Further functions are listed out in article 5, covering in particular: (a) development of research concerning pollution and climate; (b) elaboration and management of an information system containing technical and scientific data; (c) supply of technical and scientific assistance to the Regional Authority; (d) formulation of technical advices concerning the restoration of the environment; (e) performance of pollution control campaigns; (f) controls on chemical, physical and biologic aspects; (g) research, surveys and studies with regards to marine and coastal pollution control. The ARPAM shall be subject to inspections to be carried out by the Regional Council. All activities to be carried out shall be provided for in the Annual Programme to be drawn up by the Director-General (art. 12). Provincial coordinating committees shall be established, under each Province, to contribute to the achievement of the aims pursued by this Act (art. 16). In addition, agreements shall be concluded between the Region, on the one hand, and the European Agency for the Environment (referred to in Regulation 1210/1990/EEC), the National Agency for Environmental Protection (ANPA) and the University of Molise, on the other hand (art. 18). Title III lays down provisions in matter of financial resources.
