The functions entrusted to the regional authority in this field shall be exercised with a view to preventing the deterioration of the ecological balance and ensuring the restoration of polluted areas. Those regional functions are to be performed in conformity with the legislative framework laid down at national level and referred to in article 1. The protection of the environment shall encompass the following: (a) emissions into the atmosphere; (b) noise; (c) use of surface and underground waters; (d) discharges into surface waters, both inland and marine; (e) realization of works and installations that are likely to have an impact on the surrounding environment. Environmental protection shall lead to prevention and restoration actions and interventions as per article 3. Articles 4 to 6 define with detail the functions and tasks belonging to the Region, the Provinces and the Communes. The regional authority shall be in charge of the collection of relevant data and information, the elaboration and approval of regional plans and the transmission to other local entities of directives and the coordination of provincial and local monitoring systems. Title II of the Act describes the institutional framework, including the Department for Ecological and Environmental Protection (art. 10) and technical commissions at regional and provincial level (arts. 11 to 14). Title III, which deals with the preservation of the environment as a whole, regulates the content and the procedure to be followed when approving the Regional Environmental Plan. Chapter II of the same Title regards more specific plans, namely the Regional Plan on Air Quality (art. 22) and the Regional Plan on Waters (art. 24). Title IV lays down particular provisions relating to the protection of air, waters and soil. Article 60 concerns the approval of the sewerage regulation. Articles 65 and 66 lay down penalties.
