As referred to in article 1, "internal waters" includes fresh and salt waters defined by sea boundaries. Organisms other than osseous fishes may not be captured. Nevertheless, exemptions from this prohibition may be provided for by Provincial Regulations. Administrative functions in matter of fishery and protection of inland water fauna are entrusted to the Provinces. The Region is, on the other hand, in charge of the Regional Register of Fishery Associations referred to in article 7. Within six months from the entry into force of this Act, the President of the regional authority shall establish by Decree the Regional Advisory Technical Committee for Fishery and Inland Water Fauna, which shall formulate advices and proposals in matter of internal waters management. Furthermore, within one year from the entry into force of the Act, the Region must approve the Regional Fishery Chart, as a result of scientific research on the basins which fall within the regional territory. The Chart shall be updated every seven years and in the event of water changes. In accordance with article 9, the regional authority shall lay down the Regional Fishery Plan, which shall concern in particular repopulation policies as well as the enforcement of Legislative Decree No. 152 of 11 May 1999. Article 10 regulates fishing licence, which is compulsory for fishing in internal waters (art.10, paragraph 5 specifies the persons for whom such licence is not required). Article 11 regulates the procedure to be followed for the issuance as well as taxes. Article 14 defines: a) periods when fishing is not permitted; b) species that may be captured; c) fishing gear and fishing methods allowed. Surface and groundwater is defined by article 21 as public water. Priority shall be given to human consumption of such water. Other uses are permitted only in case of water sufficiency.
