An application for the grant of a plant breeder's right may be filed by the owner of the variety which shall fulfil the requirements of novelty, distinctness, homogeneity and stability (sects. 2 to 7). Aim, duration, termination, etc. of a plant breeder's right are provided for in sections 14 to 18. The applicant for a plant breeder's right must, within three months after the filing of the application, propose a variety denomination (sects. 22 to 27). The holder of a plant breeder's right may grant to any person an exclusive or a non-exclusive licence to perform any of the activities listed in section 14 which include the production or reproduction, selling, exporting, importing of the plant variety. The Director shall keep and maintain a Register of Plant Breeder's Rights which shall contain information specified in section 43. Texte intégral Anglais
