The Ornamental Plants Council will authorize or will renew an old authorization to a person to operate as an exporter of cuttings, seedlings, seeds or any species of ornamental plant that he grows if the following conditions are fulfilled: the request has been properly formalized, the person has proof of running a decent accounts system and has the financial provisions for running his activity, the person has accepted to participate, when ordered by the council, in a parity settlement between the authorized exporters and the growers regarding the import taxes inflicted by the target countries. The Council can authorize a person to be an exporter of cuttings, seedlings, seeds or any species of ornamental plant grown by others when moreover the aforementioned he can provide with contact documentation regarding exclusive commitments of other growers with him and that, regarding EC exporting target countries, growers had exported in the precedent exporting season for the amount of at least DFL 2 000 000. The last date for authorization requests is 30 April of each exporting season and the authorization or its denial will be expressed within the 1 July. An export authorization is valid for one exporting season and cannot be passed to another unless special conditions and authorizations are obtained. The Council can revoke an authorization whenever one of the issuance requirements is not fulfilled or other reasons listed in section 8 are involved. A person whose export authorization has been denied or revoked may appeal within 30 days to an Appeals Committee appointed by the Minister of Justice that shall decide regarding this issue. A person requiring an export authorization for ornamental plants must however require an exporting license from the licensing authority of the Ministry of Agriculture.
