Résumé

The scope of this Order is to regulate the granting, renewal and cancellation of the right to conduct environmental audits and related activities of qualified environmental audits. The right to conduct an environmental audit shall be granted by the central state administrative organization in charge of environmental affairs to Mongolian legal entities that meet the requirements and conditions specified in the relevant law and this regulation. The environmental auditor shall independently approach the situation in accordance with relevant laws, regulations, and methods, and adhere to the professional knowledge, skills, experience, and ethical principles specified in this regulation. A legal entity authorized to conduct environmental audits shall only conduct environmental audits. Environmental audit activities can be conducted by a limited liability company. A legal entity applying for the right to conduct an environmental audit shall meet mandatory requirements and pass certification. Authorization for conducting environmental audit shall be valid 5 years that can be extended for another 5-year period. The customer of the environmental audit has the following rights: (a) select a legal entity authorized to receive environmental audit services; (b) require the authorized legal entity of the contractual environmental audit to keep confidential the appropriate information related to the technical, economic and other related assessments, technology and business activities of the project; (c) provide feedback on environmental audit recommendations; (d) ownership of environmental audit reports; (e) request to replace the member of the audit team on specified grounds; and (f) if deemed necessary, insure obligations under the ecological liability agreement.
