Résumé

This Regulation establishes the requirements for timber extraction classified as entrepreneurial activity related to cutting of forest stand and logging. Timber extraction is carried out in accordance with this Regulation, the forest plan of the constituent entity of the Russian Federation, the forestry regulations of a forestry district, as well as the forest development project and the forest declaration (with the exception of cases of timber extraction on the basis of a contract for the sale of forest plantations or a contract specified in part 5 of article 19 of the Forest Code). Citizens have the right to extract timber for heating purposes, construction of buildings and other personal needs. In places of traditional residence and economic activity of persons belonging to the indigenous peoples of the North, Siberia and the Far East of the Russian Federation and leading a traditional way of life, these persons have the right to extract timber for their own needs free of charge based on the established rates of timber extraction. Citizens are authorized to extract timber for their own needs on the basis of contracts for the sale of forest plantations. In the process of timber extraction shall be prohibited: (a) the use the channels of rivers and streams as trails of portages and forest roads; (b) damage to forest plantations, vegetation cover and soil, littering of forests with industrial and other waste outside the cutting area on adjacent 50-meter strips; (c) damage to roads, bridges, clearings, drainage network, road, irrigation and drainage and other structures, riverbeds and streams; (d) to leave rubble (including trees cut down and left in the cutting area) and felled hanging trees, damage or destruction of undergrowth subject to conservation; (e) to destroy or damage boundary, block, logging and other pillars and signs; (f) to cut and damage trees that are not intended for felling and are subject to conservation in accordance with this Regulation and the forest legislation of the Russian Federation, including sources of seeding and plus trees; (g) to harvest timber after the expiration of the permitted period (including granting a deferral), as well as timber extraction after the suspension or termination of the right to use the forest plot; (h) it is not allowed to leave timber that has not been taken out within the established period (including granting a deferment) in the cutting area; (i) removal, skidding (transportation) of timber to places not provided for by the forest development project or the technological map of logging operations; (j) non-fulfillment or untimely execution of work on clearing the cutting area from logging residues (wood residues formed in the cutting area during felling and hauling (transportation) of trees, as well as when cleaning trunks from branches, including the top parts of cut trees, twigs, branches, brushwood); and (k) it is not allowed to destroy the upper fertile soil layer outside the portages and loading areas.
