Résumé

This Methodology sets forth the procedure for establishing, adjusting or modifying prices/tariffs for public water supply and sewerage services. It establishes the methods for calculating prices and tariffs for public water supply and sewerage services. Prices and tariffs must ensure the economic viability of operators providing public water supply and sewerage services, the interests of users, including in terms of their affordability, as well as environmental protection regarding the conservation of water resources. National Regulatory Authority for Community Services of Public Utilities (A.N.R.S.C.) approves the prices and tariffs for operators of suppliers/providers of public water supply and sewerage services and approves the prices and tariffs for economic operators who are not under the authority of local public administration authorities, who provide water supply and sewerage services. The local public administration authorities may approve different prices and tariffs from those approved by the A.N.R.S.C., on the condition of ensuring the financial autonomy, profitability and economic efficiency of the operators/providers of water supply and sewerage services. The prices and tariffs related to water supply and sewerage services are based, in compliance with the calculation methodology established by the competent regulatory authority, on the basis of production and exploitation expenses, maintenance and repair expenses, depreciation related to fixed capital in tangible assets and intangibles, the costs for environmental protection, the financial costs associated with contracted credits, the costs deriving from the management delegation contract, and include a quota for the creation of sources of development and modernization of public utility systems, as well as a profit quota. When substantiating prices and tariffs, operators can include in their level a quota corresponding to water losses from the system, justified by its technical condition. The operator or economic operator of services that requests the establishment, adjustment or modification of prices and tariffs for public water supply and sewerage services submits to A.N.R.S.C. the following: (a) the request for establishment, adjustment or modification, which contains: the prices in force, in case of adjustment or modification, the requested prices and the justification of the proposal for establishment, adjustment or modification; prices or rates for population proposed in the application submitted to A.N.R.S.C. will be determined, including the VAT rate, approved according to the legal provisions in force; (b) substantiation sheets for establishment, adjustment or modification; (c) technical-economic memo justifying the opportunity to establish, adjust or change prices and tariffs; and (d) other data and information necessary to substantiate the proposed prices and tariffs.
