Résumé

This Order specifies elaboration of land reclamation projects related to soil cover disturbed by mining, exploration, construction and other works. Elaboration of land reclamation projects shall be subject to licensing. The following factors shall be taken into consideration in the process of elaboration of land reclamation projects: (a) natural conditions; (b) prospects of land use planning; (c) actual or foreseeable state of disturbed land; (d) agrochemical or agrophysical properties of soil; and (e) environmental protection requirements. Elaboration of land reclamation projects shall be carried out in the following cases: (a) after allotment of a plot of land the use of which shall entail soil disturbance – after decision of local self-government on land allotment and land transfer; (b) in case of change of specific land use – after decision by local self-government on change of specific (purposeful) land tenure; and (c) on previously disturbed land/soil in case of lack of information on the responsible for land/soil disturbance – by decision of local self-government body.
