Résumé

This Fishing Regime shall be applicable to the Black Sea with all its bays, coastal lakes, estuaries, lakes, channels connecting the sea with the estuaries, including the water areas of the nature reserve fund. The rules related to the Danube River apply to its area before the mouth of the river. Accordingly, this space is not covered by the norms provided for the Black Sea. The area before the mouth of the Danube River is considered a part of the Black Sea with a width of 5 km, adjacent to the mouth of the Danube River. It is prohibited to carry out special use of aquatic biological resources on fishing vessels in the absence of vessel’s documents. Users of aquatic bioresources who engage in fishing are required to mark passive fishing gear, as well as active fishing gear. Marking of fishing gear must comply with the National Standard of Ukraine. Users of aquatic biological resources in the process of the special use of aquatic biological resources within the limits of the forecast of allowable catch are obliged to provide the territorial body of the State Fisheries Agency with operational information on the volume of extraction (catch) of aquatic biological resources. Users of aquatic bioresources are obliged to urgently report cases of bycatch of aquatic bioresources, the species of which are listed in the Red Book of Ukraine, to the territorial bodies of the State Fisheries Agency and territorial and interregional territorial bodies of the State Ecological Inspection. Spawning ban on specialized turbot fishing of the Black Sea is established from May 1 to May 30 and turbot, which was caught during other types of fishing during this period, is released into the sea, regardless of its viability. This Fishing Regime establishes authorized fishing gear and fishing methods. The following types of fishing shall be prohibited: (a) fishing of aquatic biological resources listed in the Red Book of Ukraine; fishing of sturgeon species and hybrids thereof; fishing of spawning female crayfish and crayfish species of non-commercial size; (b) specialized redlip mullet fishing with nets in established fishing areas; (c) the use of nets in the mouths and channels of lakes and estuaries connected to the Black Sea, the use of fixed fishing gear in the adjacent water area for 500 meters on both sides of the mouth and in the depths of the waterbody throughout the year; (d) specialized katran fishing with nets; (e) use of baited hooks during fishing; (f) specialized stingray fishing with nets in the Black Sea from November 1 to December 31; and (g) fishing for phyllophora and cystosira (except for collection of storm emissions of cystosira). Bycatch of aquatic bioresources prohibited for fishing and aquatic bioresources subject to a spawning ban during fishing, as well as animals that do not belong to aquatic bioresources (amphibians, reptiles, birds and mammals), should be immediately returned to the natural environment, regardless of their condition. When returning such animals to their natural environment, it is necessary to avoid injuring them.
