These regulations shall come into force on 1st January, 2021.
Résumé

In its first of thirteen articles, the Regulation sets its purpose as being the establishment of a regulatory framework for the applicability of the OPRC Convention and the OPRC-HNS Protocol, the provision for the applicability of the National Contingency Plan and the provision for the requirement to have in place marine pollution response emergency plans for marine terminals, marine facilities and ports. The Regulation follows with the definitions (article 2) and sets the National Contingency Plan among the Laws of Malta, establishes its field of application (art.3) as well as the National Competent Authority responsible to implement, maintain, update and enforce it ( the Authority for Transport in Malta) (art.4). The Regulation follows detailing the powers (art.5) of the National Competent authority (art.5) as well as its responsibilities for preparing pollution emergency plans for the ports under its jurisdiction, administration, management and control (art.6). Article 7 specifies that, although there may be joint plans between the Authority and operators of marine terminals and operators of marine facilities located within the same port area, each marine terminal and each marine facility shall have their respective separate pollution emergency plan. Article 8 sets the duty to report polluting incidents to the National Competent Authority, laying on every marine terminal operator and marine facility operator and on every ship master. Th Regulation follows with the provision of administrative fees payable with reference to a pollution emergency plan (art.9), offences against the provisions of these regulations and relevant penalties. The Regulation ends clarifying the non exhaustive character of the offences and punishments provided thereof in favour of other laws and regulations concerning pollution and emergencies, which remain applicable.
