This Decree enters into force the day after its publication in the Official Gazette.
Résumé

This Decree, consisting of 53 articles, focuses on the pesticide value assessment to ensure that only those products that make positive contributions to pest management are registered, eliminating unnecessarily high use-rates; ensuring that even products of acceptable risk are approved for use only if their positive contribution to pest management is clear and significant; and ensuring that proposed risk-mitigation methods are simple, cheap and practical. The Agricultural Pesticide Committee (APC) is the sole statutory agency fully responsible to run the agricultural pesticide regulatory system through detailed pre-market assessment and post registration monitoring activities. The APC determines the permissible amounts for handling and use of such pesticides, regulates their mode of handling and application, and their trading, in line with the FAO Code of Conduct.The APC must refuse to register or amend the registration of any pest control product if the applicant fails to establish that the product has merit or value for the purposes claimed when the product is used in accordance with its label directions. The applicant must provide APC with the results of scientific investigations regarding the effectiveness of the control product for the intended purposes and its safety to the host plant, animal or article in relation to which it is to be used. Non-compliance with conditions of registration could lead to suspension, cancellation, use restriction or phasing out of a pest control product. The registration certificate of the technical grade or formulated pesticide is valid for a period of six renewable years from its issuing date. After issuing of the registration certificate, the stakeholder may apply for getting the pesticide label (two-year) after payment of the prescribed fees.
