Résumé

This Ministerial Decree classifies hazardous substances by categories and validates the Regulation on inspection of transboundary movement of waste. It establishes the mechanism of the implementation of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal. Inspection of transboundary movement of hazardous waste shall be based upon written notice forwarded by the competent bodies of the countries concerned and written authorization for carrying out the aforesaid movement. Notifier can be manufacturer of waste, exporter or competent body of the exporting country. Export of waste shall be prohibited to: (a) the country that has prohibited import of the aforesaid waste having notified the Republic of Moldova thereof; and (b) the country that cannot confirm safe disposal of the aforesaid waste. In case of transit of hazardous waste the central authorized environmental institution of the Republic of Moldova shall be notifies in written form in Moldavian or English of any movement of hazardous waste through its territory. Written notification must contain the following: (a) origin, composition and quantity of waste; (b) initial point and final point of transportation; (c) coordinated route; (d) proof that importer, exporter and transporter are prepared to perform operations related to transport and treatment of waste; and (e) guarantee of complete compensation for environmental damage.
