Résumé

This Ministerial Decree establishes the modalities for licensing the operation of chemical plants by legal persons and/or individual entrepreneurs. The Federal Ecological, Technological and Nuclear Supervision Service shall be the licensing authority. Hazardous chemical plants include production sites that process, transform, store, transport or destroy toxic or hazardous substances. Licences shall be issued for five years and may be extended by application of the licence holder. Licensing terms and conditions shall include: (a) availability of construction materials, facilities and equipment; (b) availability of documents to support bringing the plant into operation; and (c) observance of industrial safety requirements. Any action resulting in an explosion or in emissions of hazardous substances shall be considered a gross violation of the licensing terms and conditions.
